On 22/11 we went to Comet to buy a Humax pvr. They assured us it would be instore by 28/11. It wasn't. They have taken the money from my account on the day of purchase/order but are now telling us it won't be around till 8th December and they willl not guarantee we will have a machine allocated to us. Is this right and legal? Seems to me if they can't guarantee me my order they should at least not take the cash. But to them if we want our money back they are suggesting cancelling the order, i.e. our name will be taken off their list of buyers.

happened to me with benson beds i cancelled as they kept moving delivery dates, got the money refunded on to my CC and went elsewhere.

Yes they can do it and are effectively treating it as an order awaiting delivery. If they cannot guarantee a delivery and that doesn't suit you then your only option is to cancel.
The same applies for onlines orders (Distance selling regs), the retailer is entitled to have 30 days in which to deliver.
