I moved house in 2005 and shortly afterwards closed an MBNA credit card, paying it off in full. I cancelled all DDs on the card.
In Aug 2007 I had a demand from MBNA, sent to my new address (which they found as I had no reason to supply it) for transactions subsequently made on the card - they were DDs that I had cancelled - as indeed I had cancelled the CC.
I made a complaint but as I recognised the transactions I paid and MBNA stated that they would close the account when the cheque had cleared, It cleared a few days later. I have proof of this from my bank.
At the end of November 2008 I received a call from a debt collection agency who has bought the debt demanding my payment of default on this card. I was told that I would receive a letter with more details. It arrived Monday 1st December, demanding a payment towards the sum outstanding but no details. I then received a letter from the agency's debt collection arm on 3rd December demanding full payment. I had no correcpondence from MBNA at any point after closing the account (for the second time) in August 2007. It is worth noting that they had my new address from August 2007. I have no idea what transactions comprise the sum they are demanding.
I have sent all correspondence about this to both arms of the debt collection agency and the Financial Ombudsman (to arrive this Tuesday 9th Dec by next day special delivery).
I don't know whether to pay before my credit rating is affected and then start legal proceedings or to hold off for now. If I pay now will I then get to reclaim the sum or is the money lost for ever? Should I send a letter from a solicitor now? How long does the F Ombudsman take to address this issue - and can I afford to wait until they do?
Is there a site and/or a solicitor that I can approach for advice about this that you can recommend? Is there a template letter - or process - that I can use to delay the 28 day automatic default notice? I have no money right now. Has there been a similar situation that would help me understand what the hell is going on and how to deal with it?
