The reason I ask is that an agreement signed on the premises can be classed as non-cancelable i.e. you don't have a cooling-off period. In practice though, I think many card issuers do allow you cancellation rights even if you sign in a branch. If you took a non-cancelable agreement home to sign, then I think this may call into question whether the agreement is enforceable. The first step is to write to the lender asking for a copy of the agreement. I would expect a lot of noisy moralising on this subject from some forum members. I see PROLIANT has already started the ball rolling with his particularly fatuous question. In my experience, OPs don't typically get a great deal of detailed practical advice on this subject here. I would suggest that you take a look the Debt Free Wannabe Forum or http://www.consumeractiongroup.co.uk/ and the forums there. Do check back and let us know how you get on though. I concur with NickX. first step is to request a copy of the agreement under section 79 of the Consumer Credit Act. How they respond to this is a good indication in itself - they will probably try and fob you off with a copy of a blank application form and some generic T&Cs. If they they think they have a valid agreement, then they might just as well send a photocopy of it - after all, they will need to produce one in court anyway if it gets that far. Thats the first step. Where you go from there depends on many factors - most of all your appetite for a fight. It wont be an easy ride - if you stop paying, the WILL harass you for the money, be in no doubt about that. I wont deny that there is a moral view on this. You need to decide for yourself if you think it is the right thing to do. You may choose that you would prefer to continue paying, or trying to negotiate a payment plan or some other kind of debt remedy. However, knowing you have an unenforceable agreement puts you in the driving seat for those negotiations. I would refer you back to my previous post where I suggested you might like to look at the DFW board and the Consumer Forums - this advice still stands. |
