What can I do????????????????????

I believe that a debt collector that contacted me violated the Fair Debt Collection practices Act. Can I seek any legal action in this matter?

No !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! ???????????????????????

Annoying, isn't it ?

IAAL Dear I Am Always Liable,
I suppose in this case I would have two questions for you.
If I can't seek legal action, then why is the Fair Debt Collections Act a law, and secondly, I was just wondering why can't I seek legal action if my consumer rights were violated? Thanks for the first response.

My response:

Okay, thanks for responding in normal fashion.

If you can tell me EXACTLY what they did to you, very succinctly, then I'll be able to tell you whether or not they have violated the FDCPA.

If they did, I'll let you know what you can and cannot do.

(Ooops ! I just looked at my clock and I have an appointment to get to. Perhaps Steve Halket will jump in for me - - or, if not, I'll get back to your post a little later this afternoon)

Okay, I'm back.

Please answer my question.

Thanks,

IAAL Curly, read the act. The you can specify exactly which section was violated. http://www.financeadvocate.com/collection/FDCPA.htm Dear I Am Always Liable,
I believe that he violated section 805b which states that in no way shape or form is the debt collector allowed to share any information concerning such debt with a third party without my consent. I'm not a minor. The gentleman allowed my father to listen in on a phone conversation he and I were having, therefore, providing my father with information he should not have without my consent.
Thanks for your time,

My response:

I'm not sure if I'm understanding you. Was your father on an extension phone; e.g., on another phone in your house ? If so, how can the creditor / collector be in control of who picks up another phone ? Couldn't you have instructed your father to hang up ?

A collector is not responsible if someone else wants to listen in on the conversation. As long as the collector is talking to you, then that's all that matters.

IAAL Dear I Am ALways Liable,
No my father and I were at separate residences and phone numbers at the time. The debt collector called both of us at the smae time, and connected the call somehow and allowed my father to listen to our whole conversation.

My response:

Again, you could have instructed your father to hang up.

I don't think you have a Cause of Action. The Collection Agency was probably trying to locate you, and called both numbers.
