i live in indiana. the collection agency is out of new york. my 23 year old son lives 2 hours away. on the evening of jan. 22, my phone rang and it was someone asking for my son. i told the woman my son was not here. i asked if i could take a message. she informed me that she was with a collection agency and that my son had written a check for $300 some dollars in 1999 and the check was sent back because of insufficient funds. she also said that if my son did not pay this, that he was going to be prosecuted. i was shocked, of course, and not wanting him to be prosecuted, his father and i agreed to take care of this immediately. the agency said that they would electronically take the amount of $400 out of our account. the extra was for interest. i told the woman i would have to transfer money from another account to this one. she said there was no hurry because i would first receive a letter stating the transaction and all the details. i received no letter, but since i was in town yesterday morning, i made the transfer so that the check would be honored. today, i received a notice from my bank that i was charged $22.50 for insufficient funds because the collection agency tried to take the money out last friday, the 26th. i called the collection agency. i was told that they sent the letter to my address, but it was returned to them saying the address was invalid. i have lived here for 12 years and my son still receives mail here. i didn't get to talk to the woman i talked to the first time. i told this new person that i had been waiting for this letter before transferring money, because i was told by the first woman that until i received this letter, no money could be electronically taken out. they knew i did not get the letter because they admit the letter came back to them. they had my phone number. now questions are popping in my head. isn't it against the law for them to disclose any information to even me about my son't debt? and isn't it against the law for them to try taking money from an account when no letter has been delivered to the person? i haven't been overdrawn at a bank in over 20 years! now i owe my bank $22.50 for this insufficient fund. i keep just enough in this one for bills. i do plan on calling my bank tomorrow and stopping the transaction in case they try to take it out again. i don't know how to handle it from there. can someone advise me? i know! if my son hadn't written the check, this wouldn't have happened. that isn't even the point now! what rules regarding this do collection agencies have to follow?
