| What is the name of your state? CA. I am not on disability but I am on work restriction. I have been paying extra on most of my credit cards for the credit protection service. It has been an awful experience trying to get anything activiated, not to mention the difficulty in even qualifying to make a claim w/out being fully disabaled. I ahve been dealing with them since March and have received a few offers of hardship payment plan for 6 to 9 months. The payments would only be about $10 less a month for each! Im not sure what to do next..I need to hold them off bec Im trying not to file BK right now. I need a hardship plan of no payments right now until divorce is settled. Thanks for any advice. None of the creditors are going to accept 'no payments' in a hardship program. They want SOME promise of payment and they want it on time or they bounce you out of the hardship program immediately. Its highly unlikely that any of them will put you on a hardship program until you're at least 3 months behind, closer to 4 is even more likely. Its also highly unlikely that any of them will sue prior to charge-off (6 months of insufficient or non-payment). Best thing to do, really, is to let them go if they refuse to put you on hardship. They'll come around once the accounts go unpaid for 3-4 months, THEN they'll be more willing to negotiate. It has been 4 months since any payment at all. I have sent in all the claim forms from my doctor stating I am on temp restrictions. I cannot file BK for some time due to upcoming divorce settlement. Ive agreed to wait until after the proceedings and final order. I just dont want the creditors to sue me before then! If we dont settle this next wed then we dontr even go to court until sept!! Some creditors are getting more sue-crazy than others. Discover will sue you for $20 right after charge-off !! A lot depends on how much you owe whether or not most of them will sue. In general, they'll go the collection agency route for a while to see if they can squeeze any money out of you. They will be a pain on the phone, so don't answer it, you have no obligation to do so. You may be able to dodge long enough to get to BK court. |
