Have a $10k balance on a Visa and about $50k in medical bills from an accident. Spouse is retired on SS. I am just getting back into the work force with disability in both hands and very limited.

Been trying for several years to dig out of this CC debt. The accident was the last straw. I have no problem going chapter 7, but I have a lawsuit pending b/c of the accident. My lawyer states it will hurt my case.

Problem is I can't afford the $270. a month visa pymt on our $1,000. a month income... not if I want to eat. Had savings but medical and no income has dwindled it to enough to get out of town...if we hurry before it's all gone. As it is a roof over our heads (rent) is becoming impossible on the slave wages in this state. Gawd what were we thinking in coming to this backward state??!!

So, with few job prospects around here and the absurd wages ($7. an hr is like GOLD to these ppl and they're happy as a pig and **** to get it)...what can the credit card company do to me if I just let the bill ride, change my phone # until we can get out of this god forsaken hellhole?

If worse comes to worse I can do a chapter 7 (zero assets) and if it hurts the case, so be it. No guarantees with that and I can't keep paying $270. for a "maybe" settlement down the road.

Bank account is joint. Only money that goes in is direct deposit of SS check each month. The checking account is joint, but the credit card is in my name only.

Can they touch this joint bank account?
