Ive read posts about checking accounts being seized for bad debts. I have many debts that are reaching the 4 year SOL and got a call from a collection agency who said if I did not return their call within 72 hours they were going to "file paperwork" in the county I reside in. Since these debts are so old I do not have a clue wich creditor this call was for but I figured the heat would be turned up on all of them since it was getting so close to the SOL. Here is my question.
This call came 2 weeks ago. If they filed how long does it normally take to get served papers. Since I work out of my house and am usually on the road..how hard do they look to find me to serve the papers. Im worried someone could have filed and I never got notified of a court date. CAn that happen and what would I do if it did and I didnt show up in court to present the SOL?
I am also very worried about depositing money into my checking account to pay bills. Ive read about creditors seizing checking accounts without the debtor knowing and checks bouncing. Does this happen when a creditor files for a judgement or after a judgement has been awarded?. I do know I tried to pay some with "check over the phone" method years ago so they have my number.
