There is no way to make this short, sorry. A few years ago a credit card company was going to take me to court to get payment. I got a summons and it stated that I owed $4143.60 in actual charges and $1381.20 in attorney fees for an amount of $5524.80. Before the court date the attorney sent me a letter saying if i would set up a payment schedule it would not go to court. I owed the debt and wanted to pay it and save the embarrasement of going to court, so I read the aggrement and set up a payment plan. I have now been paying on it for 3yrs @ $100.00 a month. The lawyer recently sent me a letter saying they would accept 50% of $5910.12 if I payed within 30 days. I have already paid over 50% of the amount on the court summons.
The agreement I made to pay this said nothing about interest and I was under the assumption that all I would have to pay was the amount on the summons. I called the lawyer and he told me that $5524.80 was not my beginning balance because the court had not given them all their attorney fees on the summons and that my beginning balace was over $6000.00. I asked if the $5910.12 was what they showed that I owed and he said no that I owe $4516.12. He could not tell me where the $5910.12 came from and said it must have been an error. What are my rights. I have paid over $3000.00 on the debt but according to them still owe $4516.12. At this rate it will never be paid off as I do not have a lump sum I can send at this time. What should I do? Should I stop paying and let it go to court, or pay them for the rest of my natural life. Some please help I do not know what to do. I dont really have the money to hire an attorney. Any advice will be appreciated.
