Alas, I'm still haggling with the credit card company over a business card (with my name and the company's name on it) I destroyed over a year ago when I left the business, and alerted the credit card company that I no longer had the card.

They're still calling regularly.

I had a long conversation with them yesterday, which I recorded.


1) They admitted that they've never billed me for the account, since they don't have my address. I gave them my current address. Oddly enough, I have another, personal, card with them so they had my contact info.

2) Even though I told them that I've submitted in writing that I'm contesting the charges, the manager asserted that they can continue to call, since this is a business account. Do the laws really not apply in this case? They say they're holding me personally responsible for the charges, so it seems like the fair debt collection act would still apply.

3) They called me yesterday, 7/31, and today, 8/1. Today's call was at 8:12 am...this seems to be a violation of the law both in terms of harassment and in the time of call.

4) They assert that I've signed a document wherein I agreed to assume all credit card debts of the corporation, so it doesn't matter that I authorized no charges and have never been billed. I really don't think I signed such an open contract. I signed a company contract some weeks before getting the card, but it was nothing with the credit card company (about 8 lines, mostly identifying who was who, and that I'd only use the card for company purposes). In any event, shouldn't they have contacted me long before now? In any event, I'll send out a letter asking for this alleged document.

5) I haven't got around to asking how much they think I owe them, but I do remember some things going on at the company. Let's assume that the contract alleged in 4) is valid.

a) If the company increased their credit line after I got the card, would that not render the contract invalid without my approval (since at the time of signing, I would only have agreed to the initial credit limit)?

b) I *think* the company renegotiated their debt using an "Assist" program, where they made a monthly payment with the balance due after a year. If this renegotiation took place, would this not render the contract invalid without my approval (since this would constitute a major change in the terms of the contract)?
