My husband is in a similar situation, we recently obtained copies of his credit reports from Experian, TransUnion and Equifax, and we see on one of them there is a judgement against him from 10/00. After looking into this further it is for a medical bill - his ex-girlfriends stay in hospital while giving birth to their son. We sent a letter of validation to the collection agency and the information they sent back was a cover letter saying 'Enclosed please find a copy of the charges that you are responsible for services rendered. Please contact our office to make arrangements to pay this account in full.' and two statements, one outlining all the treatment she received while in hospital and the other outlining the treatment their son received. Neither of the statements have the hospital name on them, or my husbands name. My husband has evidence that the debt they are claiming for his son was paid before the judgement was even filed, however it was through a different collection agency. My husband knew nothing of this debt until May 27, 2002 and apart from the responce letter he received from the CA yesterday he has had no correspondence or communications from them in regards to this. The CA has been deducting payments from his ex's account but not his, I assume because they can not provide proof it is his debt. Assuming it is only his ex-girlfriends debt that remains, by the way she had her own insurance. Is there any way that my husband has any legal financial responsibility for this debt? If not, is it at all possible to have the judgement vacated as the debt is not his? I am in the process of drafting up a second letter to send to the collection agency, if you have any suggestions I sure would appreciate them. I don't know if I have been very clear, but if you need more info just let me know, I will be happy to provide it.
