I have recent medical bills that were sent to IMBS, a collection agency out of Florida earlier last month. I received a letter that the debt had been transferred to them and they were attempting to collect on it. I promptly sent them a debt validation letter by registered mail and they received it nearly three weeks ago. Yet they continue to call my house day and night. Are they allowed to do this and if so, would a cease and desist letter work at stopping them? Thanks so much.

Are they reporting on your CR's? If so dispute with the CRA. You can also send a limited C&D letter, never acknowledge that you owe the debt, but ask them to only contact you by mail. You should carefully document the date/time every time they call...get a name of someone there, then tell them nothing, let them talk then say "are you finished?" and hang up. Then write notes in a small notepad after every call, with the date/time/person/ and a summary of what was said by you and them. They are already violating the FDCPA by continuing collection activities without validating this debt. The more they call, the better case you are building against them, and the more you can sue them for if it comes to that |
