I recently consulted with a lawyer about filing for bankruptcy. I have 4 credit cards along with payday loans totalling about 10,000, and my lawyer recommended that I have the payday loan places just try to deposit the checks as they normally would but that my bank would most likely bounce the checks, and we would include the account in the bankruptcy. I have been doing a bit of reading on bankruptcy online and I understand that when filing, ALL of my financial records for the past 5 or so years are open to being looked at, especially my banking accounts and it made me think of something. In 2007 I had a couple of friends receive their tax returns late (they had to file late last year due to some circumstances), and because they didn't have a bank account they signed the check over to me and gave me Power of Attorney on them (as they aren't in the same city as me and couldn't go in with me to my bank to authorize the deposit in person), and I deposited them into my account and then withdrew the money for them and also made some payments for different things that they needed taken care of. I know that they money wasn't mine to use, but when the courts look at my account, will they look at this and say that I had plenty of money to pay back my debts with? Or does it go thru the IRS and they're able to see that the money wasn't mine, but rather my friends?

Does anybody know anything about this? Will this even matter, as far as the bankruptcy goes? I was planning on filing Chapter 7, however if it's easier to do with this situation, I am considering filing 13.
