I am currently in the process of filing for BK. My question is whether I should do a 7 or 13? I have mixed feelings on this, but my primary goal is to prevent the sale of my foreclosed home.

I have been reading that a 7 will only temporarily save you home, until they can get the trustee to remove the stay. In general terms, how long is this?

I wanted to do a 7 and get rid of my debt and then have a few months, in order to try to sell my home in a short sale. Now if the stay can be removed in two weeks or so, I have no other choice than to file a 13 and repay the little debt I do have.

Please tell me if you can give me a time frame for the stay to be removed on a 7. Thank you.
